Rule Based Publication Process
- Congress passes an act and the APA provides the Agencies the authority to formulate, publish and enforce the rules.
- Agencies publish rules using a standard process - first in the Federal Register (FR) as an Notice of Public Rule Making (NPR) and then as a Final Rule. On the rule’s effective date it is updated in the Electronic Code of Federal Regulations (eCFR).
- Agencies may publish guidance, authority or opinions in diverse locations including their websites to assist users in understanding the rule and to provide guidance of the proper characteristics for operations.
